Acceptance of Terms

By creating an account or using Myndra, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the application.

Description of Service

Myndra is a cognitive rehabilitation platform that provides daily comprehension exercises, adaptive difficulty scaling, and performance tracking. It is designed as a supplementary tool for cognitive training.

Medical Disclaimer

Myndra is NOT a medical device and has not been evaluated or approved by the FDA, EMA, or any regulatory body. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Myndra does not provide medical advice, diagnosis, or treatment.

• Do not use Myndra as a substitute for professional medical advice
• Always consult a qualified healthcare professional regarding any medical conditions
• If you are using Myndra as part of a clinical rehabilitation program, follow your healthcare provider's guidance
• Performance metrics (CPI scores, fatigue flags, component scores) are for informational purposes only and should not be used as the basis for medical decisions
• Results may vary and are not guaranteed to reflect actual cognitive ability

User Accounts

• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when creating an account
• You may not share your account with others
• You may delete your account at any time through the Settings menu, which permanently removes all your data

Subscription Tiers

• Free Tier: Limited to 1 session per day with deterministic scoring
• Pro Tier: Unlimited sessions with AI-powered evaluation
• Clinician Tier: All Pro features plus patient management capabilities

Subscriptions are billed through Apple's App Store. Payment processing is handled entirely by Apple — we do not collect or store payment information. Subscription management (cancellation, renewal, refunds) is handled through your Apple ID account settings. Subscription pricing and features may change; active subscriptions will be honored at their current terms until renewal.

Acceptable Use

You agree not to:

• Attempt to access other users' data
• Interfere with the service's operation
• Use the service for any illegal purpose
• Reverse engineer the application
• Use automated tools to access the service (bots, scrapers, etc.)

Intellectual Property

Myndra and its content, features, and functionality are owned by the Myndra project and are protected by applicable intellectual property laws. Exercise passages may be sourced from public domain or licensed content.

Limitation of Liability

To the maximum extent permitted by law, Myndra and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

Myndra is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall our total liability exceed the amount you paid for the service in the 12 months preceding the claim.

Clinician Use

If you use Myndra in a clinical setting:

• You are responsible for compliance with applicable healthcare regulations (HIPAA, GDPR, etc.)
• Myndra's local-first architecture means patient data stays on your infrastructure
• You are responsible for obtaining appropriate patient consent before adding patients
• Patient data sharing is limited to session history and performance trends — no raw exercise responses are shared
• Myndra does not execute Business Associate Agreements (BAAs) at this time

Data and Privacy

Your use of Myndra is also governed by our Privacy Policy. Please review it carefully before using the service.

Termination

We reserve the right to terminate or suspend access to the service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users. Upon termination, you may request export of your data by contacting support@myndraapp.com.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the app or via email. Continued use of Myndra after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
